スマホソフトウェア競争促進法（スマホ法）を一気に理解する――狙い・対象・これからの変化 スマホは、連絡や決済、仕事、行政手続きまで担う生活インフラになりました。その入口にあるOSやアプリストア、ブラウザ、検索エンジンが少数の巨大事業者に集中すると、便利さの裏で「選べない」「代替が育たない」という競争のゆがみが起きやすくなります。スマホ法は、まさにその入口部分に、あらかじめ守るべきルールを置くことで競争を回復しようとする法律です。 どうして独占禁止法だけでは足りないのか 独占禁止法は、違反行為が起きた後に、個別の事案ごとに立証して是正する仕組みが中心です。ところがスマホの基盤ソフトは、仕様変更や契約条件の調整だけで市場構造が大きく動き、被害が表に出にくい一方で、争いになれば技術的な論点も絡み、時間がかかりがちです。スマホ法は、こうした特性を踏まえて「事後対応だけでは遅い」領域に、事前に禁止・義務を置く発想を採っています。 この法律が強調するのは、競争を強めることと安全を落とすことを同義にしない、というバランスです。スマホはサイバー攻撃や詐欺、青少年保護の論点とも常に隣り合わせなので、セキュリティやプライバシー確保と競争促進を両立させること自体が目的の一部として書き込まれています。 そして、競争は利用者のためだけではありません。アプリ開発者や新規参入の事業者が、入口で不利を背負わずに工夫できる余地が広がれば、結果として端末機能を活かした新サービスや価格競争が起こりやすくなり、イノベーションの循環が回る、というのが制度設計の筋道です。 「特定ソフトウェア」と「指定事業者」――どこを誰が規制される？ スマホ法が焦点を当てるのは、スマホ利用にとくに必要なソフトウェアとして、モバイルOS、アプリストア、ブラウザ、検索エンジンの4類型です。法律上はこれらをまとめて「特定ソフトウェア」と呼びます。 ただし、いきなり全事業者が対象になるわけではありません。まず公正取引委員会が、種類ごとに一定規模以上の事業者を「指定」し、その指定を受けた事業者に禁止事項・遵守事項がかかる構造です。規模の基準は、国内向け提供のそれぞれについて「月1回以上利用する利用者数」の年度平均が4,000万人という形で定められています。 実際の指定として、公正取引委員会は2025年3月に、Apple Inc.（OS・アプリストア・ブラウザ）、iTunes株式会社（アプリストア）、Google LLC（OS・アプリストア・ブラウザ・検索エンジン）を指定したと公表しています。 施行のタイムラインも重要です。法律は2024年6月に成立・公布され、禁止事項・遵守事項などの本体規制は2025年12月18日に全面施行とされています（指定に関する規定は先行して施行）。 何が変わる？　「選べる」状態を作るための主要ルール スマホ法の中核は、指定事業者に対する「してはいけないこと」と「しなければならないこと」をセットで置く点です。代表例として、他社がアプリストアを提供することを不当に妨げないこと、他社の課金システム利用を妨げないこと、アプリ内での外部サイトへの誘導や価格情報表示など（リンクアウトを含む）を不当に制限しないことが明示されています。 また、利用者が「デフォルトのまま固定される」状態を崩す仕掛けも入ります。ブラウザや検索エンジンなどについて、簡易な操作でデフォルト設定を変更できるようにし、選択画面を表示することが求められます。いわゆるチョイススクリーンです。 さらに、検索における自社サービスの不当な優遇の禁止、取得したデータを競合サービス提供のために使わないこと、そしてOSが制御する機能について自社と同等性能での利用を他社アプリ事業者に妨げないことなど、入口の支配を横展開して競争をつぶす行為を抑える構造が見て取れます。 実効性の担保としては、遵守状況の報告、調査権限、命令、課徴金納付命令などが整備され、課徴金の算定率は20%と説明されています。ルールを置くだけでなく、守らせるための執行設計もセットになっている点が、スマホ法を理解するうえでの要所です。 ニュースレターを購読する その日の注目ニュースを編集から直接読者へお届け！ CIO.comのニュースレターでは、IT戦略、イノベーション、マネジメント、CIOの役割、人材管理、調達、運用、規制対応などの経営トピックに加え、クラウド、AI、アナリティクス、セキュリティ、モバイル、リモートワーク、ソフトウェア開発などの最新技術も幅広くカバー。中堅・大企業や公共機関向けに、CIOやCxOの独自インタビュー、国内事例、そして示唆に富むグローバル視点の海外情報も読者にお届けします。メールアドレスを入力して今すぐご登録ください！ この著者の記事 もっと見る Read More
